By placing an order with MNDAY Performance Ltd, you acknowledge that you have read, understood and accepted these Terms and Conditions in full.

1. Overview 

This website is operated by MNDAY Performance Ltd (“MNDAY”, “we”, “us” or “our”). By visiting our site and/or purchasing something from us, you agree to be bound by these Terms & Conditions (“Terms”). These apply to all users of the site, including browsers, customers, merchants, and content contributors.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products and services to you.

2. Products & Use

· Our products are intended for healthy adults over the age of 18.

· They are food supplements, not medicines, and should not be used to diagnose, treat, cure, or prevent any disease.

· Always follow the instructions on the label. Consult your doctor before use if pregnant, breastfeeding, taking medication, or under medical supervision.

· Do not exceed the recommended daily dose. Keep out of reach of children.

3. Orders & Payment

· All prices shown include VAT unless stated otherwise.

· We reserve the right to refuse or cancel orders for any reason, including suspected fraud or product unavailability.

· You agree to provide accurate, complete, and current information when making a purchase.

· Payment is processed securely through Shopify and its trusted payment providers.

4. Subscriptions

· Subscription customers will be charged automatically at the agreed interval until cancelled.

· You may cancel your subscription at any time via your account or by contacting us at team@mndayperformance.co.uk before your next billing date.

· Prices for subscriptions are fixed at the time of sign-up but may be subject to change with notice.

5. Shipping

· Orders are shipped via Royal Mail or other reputable couriers.
· Standard UK delivery is typically 2–5 working days.
· Delivery times are estimated and not guaranteed.
· Shipping costs will be displayed at checkout.

6. Returns & Refunds

· Due to the nature of our products, we cannot accept returns once opened, unless the product is faulty or incorrect.

· Under the Consumer Contracts Regulations 2013, you have the right to cancel your order within 14 days of receiving your goods. Unopened products must be returned in their original condition at your expense.

· If your order arrives damaged, faulty, or incorrect, contact us at team@mndayperformance.co.uk within 14 days of receipt with your order number and photographs.

· Refunds or replacements will be processed promptly if approved.

7. Accuracy of Information

We aim to ensure all product descriptions, images, and prices are correct. However, errors may occur, and we reserve the right to correct them at any time without liability.

8. Intellectual Property

All content on this site, including text, images, logos, and designs, is the property of MNDAY Performance Ltd or our partners and may not be copied or used without our permission.

9. Limitation of Liability

(a) To the fullest extent permitted by law, MNDAY Performance Ltd, its directors, officers, employees, agents, contractors, suppliers, and affiliates will not be liable to you or any third party for any direct, indirect, incidental, special, punitive, or consequential losses or damages, including (but not limited to) loss of profits, loss of revenue, loss of savings, business interruption, loss of data, or replacement costs, arising out of or in connection with:

· any information, content, or materials provided via our website; or

· any errors or omissions in our service or content - even if we have been advised of the possibility of such damages.

(b) Our total aggregate liability to you for all claims arising out of or relating to any products, services, or these Terms will not exceed the total amount you have paid to us for the product or service giving rise to the claim.

(c) Nothing in these Terms will exclude or limit our liability for:

· death or personal injury caused by our negligence;

· fraud or fraudulent misrepresentation; or
· any other liability which cannot be excluded or limited under applicable UK law.

(d) You acknowledge and agree that:

· We are not liable for losses caused wholly or mainly by your own breach of these Terms;
· All products and services are provided on a commercially reasonable “as is” and “as available” basis. We make no guarantee that they will meet your specific requirements, be error-free, or operate without interruption.

Errors and Omissions (E&O)
